Terms and Conditions of Sale

1. OBJECT OF THE CONTRACT
1.1 This telematic contract concerns the sale by the company TO.DO, via Torricelli n.10 / 12 - 80047 San Giuseppe Vesuviano (NA) P.I. and Tax Code 06992661212 - (hereinafter "the supplier"), of the following clothing products (hereinafter "the Products"), purchased by the customer who is a natural person (hereinafter, "the Customer"), for purposes that cannot be referred to to their professional activity, among those offered on the website www.lepassageparis.com (hereinafter the Site). For purchases by companies in possession of a VAT number, please contact the Supplier.
1.2 The Customer acknowledges that in order to purchase the Products sold on the Supplier's Site, it is necessary to accept this contractual regulation in advance.

2. SUPPLIER IDENTIFICATION DATA
2.1 The Supplier has its registered office in TO.DO, via Torricelli 10/12 - 80047 San Giuseppe Vesuviano (NA).
2.2 The Supplier is the owner of the website www.lepassageparis.comt through which it carries out, among other things, e-commerce activities.

2.3 Customer complaints can be sent to the operational headquarters referred to in point 2.1, or to the e-mail address of the supplier info@lepassageparis.com

3. PURCHASE PROCEDURE.
After choosing what you are interested in, click on the buy button and follow the instructions. You will need to enter your details, which we will only use to fill out the invoices and be able to send you the items. We will not send you advertising, neither electronically nor on paper. The data you provide will only be used for the sale of what you have purchased. All our products will be delivered directly to your home in 5-7 working days.

4. PAYMENT METHODS.
The seller offers you various payment methods, to give you the possibility to choose according to your needs and possibilities. The choice of your preferred method will be offered to you once the purchase procedure has begun via the "add to cart" button, as well as all the related data to be able to complete the order and its payment.
PAYPAL: payment via PayPal must be made by proceeding with the payment using the button immediately below in favor of our paypal account info@lepassageparis.com. The reason to be reported must indicate the order number communicated to the Customer with the email. The goods will be shipped only when the amount has been credited.

5. DISCOUNT VOUCHERS, PROMOTIONS, GIFTS
Ambrocasual SRL will be able to insert discount vouchers within the packages, or send by email, which can be used by the date indicated on the voucher itself. The discount voucher must be entered on the order summary page and activated using the appropriate command. The system will update the total amount of the order net of the value of the voucher. The discount coupon can be combined with other commercial initiatives only in cases where it is expressly indicated, otherwise it will not be possible to combine the coupon with other commercial initiatives. The promotions on the site will take effect from the publication on the hooli.it home page of the notice of the promotion itself. The system will automatically insert the promotion in the shopping cart and, therefore, no exceptions can be requested from the customer support staff. The Supplier may send the Customers free Products. No replacement for return will be possible in relation to the Products received as a gift from the Customer.

6. SHIPPING COSTS and OFFERS

The shipping of everything you find on sale is free and will be shipped through one of our carriers;

7. PRIVACY POLICY
With reference to the provisions of Legislative Decree 196/2003, laying down provisions for the protection of confidentiality in the processing of personal data, we hereby wish to inform you that the personal data you provide, or registrations and / or acquired in the context of our business, may be processed with or without the use of electronic means, in compliance with the aforementioned legislation, for the institutional purposes of our business, and in particular for:
1. to execute a service or one or more contractually agreed operations
2. the execution of obligations under laws or regulations
3. the protection of the rights of the owner of the To.Do. in court
4. the provision of your data to To.Do. it is strictly functional to the execution of the contractual relationship or, when specified, to the activities agreed by the user;
5. the owner of the data processing, pursuant to Legislative Decree 196/2003 is the To.Do.
6. the data will be stored at our operational headquarters, having the following address: “info@lepassageparis.com (Monday> Friday, 9:00> 18:00)”, for the time prescribed by law;
7. the processing of the data provided, or otherwise acquired as part of our business, may also be carried out by persons who are granted the right to access your personal data by law or secondary and / or community regulations.
8. at any time you can request the modification or cancellation of the aforementioned data. Consumer information pursuant to Legislative Decree 22 May 1999, n. 185 (in Gazz. Uff., 21 June, n. 143). - Implementation of Directive 9l / l / EC on the protection of consumers in respect of distance contracts.

8. AVAILABILITY OF THE PRODUCT
Not all the Products on the Site are fully available to the Supplier. Unavailable products are indicated with a note highlighting the release date or the ordering of the product. Unavailable products cannot be purchased. In any case, if for any reason the Supplier cannot cope with the order due to unavailability, even temporary, of the product in stock or for other reasons, paragraph 2 of art. 6, Legislative Decree 185/1999.

9. CONDITIONS RETURNS AND REFUNDS
The right of withdrawal lapses:
- For lack of the essential condition of integrity of the good (packaging and / or its contents);
- Use, even partial, of the goods and any consumables;
- The lack of the external packaging and / or the original internal packaging;
- The absence of integral elements of the product (accessories, cables, manuals, parts ...);
- Damage to the product for reasons other than its transport;

In the cases indicated above, the seller will return the purchased good to the sender. Customers who purchase with a VAT number and those who purchase customized goods cannot exercise the right of withdrawal.
In order to exercise this right of withdrawal, the customer will send the ordered item by courier to our address within 8 (eight) working days of receipt of the products ordered.
There is the possibility of using our courier at your address for collection and / or return, with a charge to be paid in advance by bank transfer, at the shipping cost already incurred during the purchase.
Refund method: info@lepassageparis.com (Monday> Friday, 9:00> 18:00) will refund by bank transfer or Paypal as soon as possible, and in any case within 15 days of receiving the Communication. The refund refers to the price of the returned product (s). It is expressly understood that the costs of shipping and returning the product will be borne by the customer.

10. SERVICE AND WARRANTIES. LIMITATION OF THE SUPPLIER'S LIABILITY
The technical characteristics of the Products are shown in the data sheets. The Products sold by the Supplier are subject to the provisions of Legislative Decree 24/2002 on the sale and guarantee of consumer goods and, for what is not expressly provided for therein, to the rules of the cod. civ. and other applicable national standards. The Customer is the owner of the rights provided for by art. 1519 bis and ss. c.c .. The warranty applies to Products with lack of conformity and / or malfunctions not detectable at the time of purchase, provided that the Products are used correctly and with due diligence, in compliance with the various operating rules indicated therein. The warranty does not apply in the event of negligence or carelessness on the part of the Customer in the use of the Products. The malfunction of the Products must be reported in writing by registered mail by the Customer within the legal term with a brief description of the defect found in the Products, with an indication of the brand and model of the same. The Customer undertakes to verify the correct functioning of the Products. The Supplier is not responsible for any inefficiencies attributable to force majeure and / or unforeseeable circumstances such as accidents, thefts and / or robberies to the courier in charge of delivery, fires, explosions, strikes and / or lockouts, earthquakes, floods and other similar events. that prevented, in whole or in part, from executing in the time and manner agreed with this contract. Therefore, compensation for any damages, losses and costs, of any nature, that may arise from the Customer or his successors in title depending on the aforementioned causes can in no case be requested from the Supplier. Using these hypotheses, the customer will only be entitled to a refund of the price paid. Furthermore, the Supplier is not responsible for any fraudulent or illegal use that may be made by the Customer or third parties of the credit cards upon payment of the purchased products.

11. EXPRESS TERMINATION CLAUSE
If the Customer defaults on the obligations referred to in art. 10 of this contract or the obligation to pay the price, this contract will be terminated by law, pursuant to Article 1456 of the Italian Civil Code, starting from the date of sending the fax message or the e-mail communication through which the Supplier declares that he wishes to make use of of this termination clause.
